These terms and conditions ("Terms") apply to all sales, servicing, and repairs carried out by SGP Garden Machinery Ltd ("the Seller", "we", "us", or "our"). By placing an order or requesting a service, the customer ("the Buyer") agrees to be bound by these Terms.
1. General
1.1 The contract between the Buyer and Seller comprises these Terms and any other documents detailing the agreement.
1.2 The contract is governed by English law.
1.3 'The goods' refers to any products or machinery sold or serviced by SGP Garden Machinery Ltd.
1.4 'The recipient' refers to the person or company receiving the goods if not the Buyer.
1.5 Calls may be recorded for training and quality purposes.
2. Orders and Acceptance
2.1 A contract is formed once the Buyer places an order and SGP Garden Machinery Ltd confirms acceptance.
2.2 The Buyer agrees to these Terms in full when placing an order.
3. Delivery and Receipt of Goods
3.1 The Buyer or Recipient must check all goods for damage or shortages at the time of delivery.
3.2 Any issues must be noted on the carrier's delivery note and reported in writing to both the Seller and carrier within 3 days.
3.3 The Seller accepts no responsibility for delays or non-delivery beyond its control and will not be liable for indirect or consequential loss (including profit, time, or business interruption).
4. Ownership and Payment
4.1 For non-account holders, all goods and machinery must be paid for in full before being released from SGP premises.
4.2 For account holders, ownership of goods remains with SGP Garden Machinery Ltd until all outstanding sums (for any invoices) are paid in full.
4.3 Until full payment is received:
• The Buyer holds the goods as bailee for the Seller.
• The Seller reserves the right to enter the Buyer's premises to recover the goods.
• Any proceeds from unauthorised sale must be held in trust for SGP Garden Machinery Ltd.
5. Returns Policy
• Machinery, clothing & accessories (stocked items): Return within 30 days of purchase.
• Parts (stocked items): Return within 14 days of purchase.
• Special orders: Non-refundable unless faulty.
Items must be unused, in their original packaging, and accompanied by a valid receipt.
The following items cannot be returned:
• Carburettors, gaskets, PCBs, oils, or flammable goods
• Gift cards or downloadable products
• Personal or health-related items (e.g. first aid kits)
Refunds are processed once the returned item has been inspected and approved. Refunds will be made to the original payment method.
6. Servicing & Repairs
6.1 Completion dates are estimates and may vary due to circumstances beyond SGP's control.
6.2 Non-account holders: Machinery will not be released until full payment is made.
6.3 Machinery not collected within 7 days of completion may incur a storage fee of £5 per day. After 1 month, uncollected items may be disposed of following written notice.
6.4 SGP reserves the right to:
• Refuse work on unsafe or uneconomical machinery.
• Repair or replace components necessary for safety.
• Decline repairs where performance or reliability cannot be guaranteed due to age or wear.
6.5 Inspection-only charges apply when a repair is declined:
• Handheld machinery: £30 + VAT
• Walk-behind mowers: £46 + VAT
• Ride-on mowers: £92 + VAT
(Redeemable as store credit if a replacement is purchased.)
6.6 All service-related concerns must be reported within 14 days of the invoice date.
7. Workshop Intake Policy for Two-Stroke Equipment
In order to maintain workshop standards, safety, and efficiency, SGP Garden Machinery Ltd. applies the following intake policy for all two-stroke handheld machinery:
7.1 Fuel Use: Only machines running on Aspen or alkylate fuels are preferred. Machines using standard fuel may be accepted if well-maintained. We do not accept machines damaged due to fuel degradation from long-term storage.
7.2 Service History: Machines must have been serviced within the last three years.
7.3 Replacement Cost: Machines with a replacement cost under £500 may be deemed uneconomical to repair.
7.4 Condition: Heavily neglected or damaged machines will not be accepted.
7.5 Transparency: Customers are expected to disclose known faults. Misrepresentation may result in refusal of service.
7.6 Assessment Charges: All inspections are chargeable at our standard hourly rate, including cases where repairs are declined.
A full copy of this policy is available upon request or displayed at the service desk.
8. Third-Party Warranty
8.1 For products not originally sold by SGP Garden Machinery Ltd, warranty claims should first be directed to the original seller.
8.2 If SGP agrees to assist with a third-party warranty, acceptance is at our discretion.
8.3 Should a warranty claim be declined, inspection or repair costs will be payable before goods are released.
8.4 SGP accepts no responsibility for delays caused by third-party warranty providers.
9. Prices & Accounts
9.1 All prices exclude carriage unless stated otherwise.
9.2 Unless a credit account has been granted, payment is due immediately upon completion or delivery.
9.3 Credit account invoices are due by the last day of the month following the invoice date. Late payments may incur interest at 5% above Santander base rate per day overdue.
9.4 Disputes regarding invoice amounts must be raised within 21 days of the invoice date.
10. Errors & Omissions
Occasionally, errors may appear in pricing, descriptions, or promotions on our website or documents. SGP reserves the right to correct any inaccuracies or cancel affected orders without prior notice.
11. Legal & Miscellaneous
11.1 Failure by SGP Garden Machinery Ltd to enforce any part of these Terms does not waive our rights.
11.2 If any term is deemed invalid or unenforceable, the remaining Terms remain in full effect.
